【學苑專訊】兩名候任選舉監察官(Proposed Returning Officer),來自學生發展及資料中心(Cedars)的Mr. Patrick Tang及Miss Irene Yeung今日下午1時51分致函評議會主席譚振聲,及將副本發予評議員。電郵指,歷年以來,二人均願意協助學生會選舉事務(出任選舉監察官),惟今年仍未收到評議會的委任。
電郵又指,二人於1月23日收到22名評議員的聯署信件。有關信件簡述了2013年度周年大選的爭議,並建議二人避免於爭議解決前接受委任,成為選舉監察官。此外,二人獲告之評議會尚未確認委任二人。二人遂向譚查詢,1)二人是否已獲委任為選舉監察官及2) 選舉監察官的職責為何,並希望譚於1月30日前回覆。
內務副會長張楚晞早前提出兩項委任選舉監察官及選舉主任(Election Officers)的傳閱議案遭社會科學學會代表沈君浩反對,有關議案須待評議會正式討論及表決。故此,是次周年大選尚未有正式的選舉監察官及選舉主任。按照2009年版本選舉守則SECTION IV) Article 2) c) ,選舉主任須由評議會委任,負責管理票站及點票。按照同一守則SECTION IV) Article 4) 及Article 5) ,選舉監察官須為校方職員;評議會於每次選舉中至少需要委任兩名選舉察官。換言之,現存兩個選委會均無法獨力舉辦選舉,爭議須於評議會解決。
二人發出的電郵如下:
Dear Mr. Tam,
We have previously replied to HKUSU about inviting us as Returning Officers for the annual election of HKUSU 2013, as seen from the email correspondences below. We are pleased to help (on personal capacity) in polling matters as in previous years. However, we have not got further news whether the Students’ Union Council has completed the required procedures for our appointments.
As of 23/1/2013, we have received an email and a same letter jointly signed by 22 Union Councilors asking that we should not take up the role of Returning Officers. The email is attached herewith for your reference and also copied to all Union Councilors based our records. We were also told that our appointments as Returning Officers have not been confirmed by the Union Council. In this case, we would like to have your following replies:
1. Whether and when our appointments as Returning Officers have been confirmed by the Union Council. If yes, please let us have the Union Council records.
2. List of duties of the Returning Officers.
We should be grateful if you could reply by January 30, 2013, so that we can have ample time to get prepared for the duties required.

Unsettling Disputes over Annual Election 2013 of HKUSU
We are Councilors of the Union Council of HKUSU, writing to notify you the recent controversy concerning Annual Election 2013 of the Hong Kong University Students’ Union, and seek for your assistance in maintaining the constitutionality of the Election.
There have been unsettling debates concerning the validity of Annual Election 2013 and its relevant working parties. In the 9th Emergency Council Meeting held on 1st and 2nd of January, the following motions were passed: “To declare all decisions made by UEC (Union Election Committee) for Annual Election 2013 are invalid due to the conflict of interest of the UEC Chairman”. Later in the same meeting, Mr. TAM Chun Sing has adjourned the Council Meeting without the consent of the Council and disregarded Councilors’ objection over the sudden adjournment. Tam then left above meeting without addressing Councilors’ opposition.
In view of the absence of Council Chairperson, an acting Council Chairperson was elected among the Council and passed the following motions. “To vacate the duty in Union Election Committee of the following union councilors due to the improper decision made in the UEC meeting dated 13/12/2012 1) OR Man Chun, General Secretary, 2) SHUM Hin Lung, Honorary Secretary of Union Council, and 3)WONG Pak Wing, President of Cultural Association .” Subsequently, a new Union Election Committee with different members was thus set up to handle the relevant business for the Election.
However, Mr. Allen Or and the said officer-bearers continued to operate the above suspended committee. Therefore, we consider the current Returning Officer invitation by Mr. Tam problematic as the appointment addresses the potentially unconstitutional committee.
Therefore, we hereby strongly advise you not to accept the invitation by the Chairperson of Union Council as Returning Officers of the said election until the controversy has been settled. Should you have any inquiries, please feel free to contact the undersigned for further information.
